Dwarka Expressway Homes: M3M Capital Possession & RERA Guide

Possession dates are the single biggest source of anxiety for homebuyers along the Dwarka Expressway corridor — a stretch of Gurugram that has a well-documented history of handover delays tied to the expressway's own decades-long construction timeline. At Dwarka Expressway Homes, the questions we hear most often from buyers evaluating or already holding units in this belt are simple: when do I actually get my keys, and what happens if that date slips?

This post answers four of those questions directly, in a Q&A format, covering two live cases: the SCDA-designed tower at M3M Capital, and M3M Capital's broader possession schedule — plus what the RERA Act actually guarantees you if a developer misses its committed date.

Q1. When is SCDA's first project handover to the purchaser?

The original commitment was March 2026 — and that date has already come and gone without handover.

The SCDA tower sits within M3M Capital Phase 1, Sector 113 (co-designed with Singapore-based architecture firm SCDA Architects, which is why buyers and brokers often refer to it by that name). Early buyers were given March 2026 as the first promised possession window. That month has now passed, and the project remains incomplete — placing it squarely in the corridor's long pattern of slipped handovers.

Haryana RERA's own records confirm this. M3M Capital Phase 1 (RC No. 06 of 2022) was registered with a completion date of 30 June 2026. On 3 March 2026, the promoter, M/s Union Buildmart Pvt. Ltd., applied to HARERA under Section 6 of the RERA Act for an extension — and on 23 April 2026, HARERA granted it. Phase 1's new, legally binding completion date is now 29 June 2027, per HARERA's Extension Certificate No. 10 of 2026.

That 29 June 2027 date is worth flagging on its own, because it differs from the December 2026 handover many buyers say they've been told informally. Only the date on HARERA's extension certificate is the one that counts for a delayed-possession claim under Section 18 (see Q3). If your sales contact quoted you December 2026, get that reconciled in writing against the registered 29 June 2027 date before you plan around either one.

Q2. When does the homebuyer get possession of M3M Capital?

HARERA's registered completion date for M3M Capital Phase 1, Sector 113, is 30 June 2026.

The project (RERA No. RC/REP/HARERA/GGM/531/263/2022/06) is registered on a 15-acre parcel under license no. 106 of 2021, and multiple listing platforms consistently cite June 2026 as the committed handover date for this phase. Resale listings describe several towers as "ready to move," and some possession has reportedly begun in parts since late 2025, with full handover expected to continue through mid-2026.

Two things are worth knowing before you treat "June 2026" as universal:

1.       M3M Capital spans multiple phases and towers (Phase 1, 2, 3, and related projects like M3M Mansion in the same sector carry separate RC numbers and separate possession dates — one tower being ready does not mean all are).

2.       As Q1 shows, even Phase 1's June 2026 date is now under an extension application with HARERA, so buyers should not assume it will be met without confirmation.

The only reliable way to confirm your own unit's due date is to match your tower and RC number against the HARERA project page directly, rather than relying on a project-wide marketing timeline.

Phase by phase: will each deadline hold?

"M3M Capital" isn't one RERA registration — it's four, filed over three years on the same 15-acre Sector 113 parcel, each with its own promised date and now its own track record. Here's where each one actually stands.

Phase 1 — already missed, now on a second date

Registered as RC No. 06 of 2022 (amended 28 September 2022), Phase 1's original completion date was 30 June 2026. That date has come and gone: HARERA granted a formal extension on 23 April 2026, pushing the binding completion date to 29 June 2027. This is the only phase of the four with a confirmed miss on record. Whether the new date holds depends on construction progress against what a one-year extension assumes — worth checking the promoter's latest quarterly progress report (QPR) filed with HARERA, not just the extension certificate itself.

Phase 2 — not extended yet, but same site, same promoter

RC No. 87 of 2022 (GGM/612/344/2022/87), also dated 28 September 2022. HARERA's own paperwork shows two figures for this one: the registration certificate itself declares 31 December 2026, while a more recent project brief on the Authority's file lists 30 June 2027. Neither has been superseded by an extension order as of this writing, so Phase 2 is technically still "on schedule." But it shares a license, a site and a developer with Phase 1 — which makes Phase 1's slippage a reasonable amber flag, not a reason to assume Phase 2 is safe.

Phase 3 — smallest slice, furthest-out date

RC No. 52 of 2024 (GGM/825/557/2024/52), dated 16 May 2024, with a declared completion date of 29 February 2028. It covers just 0.92 acres of the 15-acre license — by far the smallest of the residential/mixed-use phases — and was described as "proposed for future construction" in Phase 2's own filings as recently as 2022. With over a year still left on the clock, there's no delay to report yet, but also the least construction history to judge it by.

M3M Capital Walk (the ~1-km retail stretch) — riding on Phase 1's clock

The retail frontage marketed as M3M Capital Walk isn't registered separately — developer listings file it under RC No. 06 of 2022, the same registration as Phase 1. That means its binding completion date is Phase 1's date: originally 30 June 2026, now extended to 29 June 2027. Anyone holding retail or SCO space here should track it exactly like a Phase 1 residential unit, using the same extension order and the same QPR filings.

*HARERA's own records show both 31 December 2026 and 30 June 2027 for Phase 2 across different filings; treat 30 June 2027 as the more recent figure until confirmed on the live portal listing.

The pattern across all four: the phase that's furthest along is the one that's already late. That's not unusual for a multi-phase launch, but it's a reason to ask which phase your specific tower or shop falls under before taking any single "M3M Capital possession date" at face value.

Q3. What does RERA say if possession is going to be delayed?

Section 18 of the Real Estate (Regulation and Development) Act, 2016 gives a delayed buyer two clear options — a refund with interest, or ongoing interest until possession.

If a promoter fails to complete or hand over a unit by the date agreed in the builder-buyer agreement (and the delay isn't excused by a genuine force majeure event), Section 18 entitles the allottee to:

1.       Withdraw and get a refund of the entire amount paid, along with interest and compensation, or

2.       Stay invested and claim interest for every month of delay, paid until the unit is actually handed over.

The interest rate isn't negotiable or builder-set — it's fixed by regulation. Under Rule 15 of the Haryana Real Estate (Regulation and Development) Rules, 2017, the "prescribed rate of interest" is the State Bank of India's highest Marginal Cost of Lending Rate (MCLR) + 2%. This is the same rate the promoter can charge a buyer for delayed payments, applied symmetrically. HARERA orders through 2023–2025 have calculated this rate anywhere between roughly 10.3% and 11.1% per annum, moving with SBI's published MCLR at the time.

Separately, Section 6 allows a promoter to apply for an extension of a project's RERA registration — typically citing force majeure or regulatory delays — but HARERA is required to publicly notify the project's allottees and invite objections before deciding on that extension, as happened with the M3M Capital Phase 1 application above. An extension changes the registered completion date; it does not, by itself, erase a buyer's right to delayed-possession interest for the period the original date was missed.

Q4. Is the homebuyer of M3M Capital going to get any kind of relaxation after possession is delayed?

Yes — but the "relaxation" works in the buyer's favour, not the builder's. It takes the form of delayed possession charges (DPC), not a waiver.

It helps to separate two different things that both get called "relaxation" in this context:

•         The extension HARERA may grant the promoter (more time to finish construction) is relief for the builder's timeline — it is not, on its own, relief for the buyer.

•         The compensation Section 18 guarantees the buyer is the actual relaxation available to you: interest on your paid amount for every month of delay, or a full refund with interest if you'd rather exit.

HARERA has applied this consistently to projects on the Dwarka Expressway corridor and in comparable M3M developments. In past orders involving M3M Woodshire (also Sector 107, Dwarka Expressway), the Authority awarded delayed possession charges at rates between roughly 9.3% and 10.75% per annum, calculated from the due date of possession in the agreement until the actual offer of possession — using the exact MCLR+2% formula described in Q3.

What an M3M Capital buyer facing delay can do today:

•         Check your builder-buyer agreement's possession clause and calculate your "due date" against the committed date, not the marketing date.

•         Send the promoter a written request for DPC — many disputes resolve without a formal hearing once this is on record.

•         If unresolved, file a complaint on the HARERA Gurugram portal; complaints can be filed individually, are affidavit-based, and typically don't require a lawyer at the filing stage.

•         Keep an eye on the project's extension proceedings — as an allottee, you have standing to file objections when HARERA invites them, as it did for M3M Capital Phase 1's March 2026 application.

One caveat: if HARERA accepts that a portion of the delay was caused by a genuine force majeure event, that specific period may be excluded when the final DPC is calculated — the Authority decides this case by case, not automatically in the builder's favour.

Dwarka Expressway Homes

Possession dates along Dwarka Expressway move — that's the pattern the corridor's history, and this project, both show. The protection that doesn't move is the one written into the RERA Act itself: a fixed, formula-based right to compensation the moment a committed date is missed.

RERA registration numbers, extension orders, and prescribed interest rates change as HARERA updates them, so treat the figures above as a starting point and always cross-check your own unit's status on the Haryana RERA portal and your builder-buyer agreement before acting.

Dwarka Expressway Homes tracks possession timelines and RERA developments across the corridor so buyers don't have to dig through portal filings alone. Have a project-specific question? Reach out and we'll help you find the answer.
